{"id":4353,"date":"2020-04-01T11:04:15","date_gmt":"2020-04-01T09:04:15","guid":{"rendered":"http:\/\/braun-avocat.com\/plainte-et-action-civile\/"},"modified":"2023-12-14T17:58:35","modified_gmt":"2023-12-14T16:58:35","slug":"civil-complaint-and-action","status":"publish","type":"post","link":"https:\/\/braun-avocat.com\/en\/civil-complaint-and-action\/","title":{"rendered":"Complaint and Civil Action"},"content":{"rendered":"<h2>CRIMINAL COMPLAINT AND CIVIL ACTION<\/h2>\n<h3>What is a civil action?<\/h3>\n<p><span style=\"font-weight: 400;\">The <strong>civil action<\/strong> refers to the action by which <strong>the victim<\/strong> of a crime can <strong>obtain compensation for the damage suffered<\/strong>. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">This action can be exercised before the <strong>criminal or civil courts<\/strong>. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is often referred to as a<strong> complaint<\/strong> or a <strong>criminal complaint<\/strong>.The term is not inaccurate but it is vague. In reality, there are <strong>two types of complaint<\/strong> : the <strong>the simple complaint<\/strong> and the <strong>the complaint with civil party constitution<\/strong> which, like the direct summons, have for objective to <strong>allow the victim to launch themselves the penal proceedings<\/strong> in spite of the principle of opportunity of the proceedings.<\/span><\/p>\n<h3>What is the opportunity to prosecute ?<\/h3>\n<p><span style=\"font-weight: 400;\">When the <strong> public prosecutor<\/strong> is informed of the commission of an offence, he is free to <strong>prosecute or not to prosecute<\/strong>. <\/span><\/p>\n<p><span style=\"font-weight: 400;\"> This principle of discretionary prosecution allows him to opt for the <strong>most appropriate penal response <\/strong>by considering :<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">\u00a0either <strong>to close the case with no <\/strong> further action ;\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">\u00a0or <strong> to initiate proceedings; <\/strong> ;\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">\u00a0or to <strong>opt for an alternative prosecution <\/strong>procedure. <\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\"> The principle of discretionary prosecution is very important in France: traditionally, it is <strong>more the prosecutor&#8217;s office than the victims who initiate the prosecution<\/strong>.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> However, there are procedural techniques that allow the victim to initiate public action: these are the <strong>simple complaint<\/strong>, the <strong>complaint with civil party status<\/strong> and the <strong>direct summons<\/strong>.<br \/>\n<\/span><\/p>\n<h2>THE SIMPLE COMPLAINT<\/h2>\n<h3>Definition &#8211; Filing a complaint<\/h3>\n<p><span style=\"font-weight: 400;\"> Any <strong>victim<\/strong> of a criminal offence can <strong>file a complaint<\/strong> with the police station or the gendarmerie of his choice. It is <strong>possible to file a complaint in a city other<\/strong> than the one where the crime was committed (in case of territorial incompetence, the complaint will automatically be transmitted to the competent services).<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> The officers or agents of the judicial police are<strong> obliged to receive the complaint<\/strong>. The complaint must be recorded and a receipt issued immediately to the victim, who may also <strong>request a copy of the record under article <\/strong> 15-3 of the Code of Criminal Procedure.<br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> The victim may also <strong>submit his or her complaint directly <\/strong> to the public prosecutor by <strong>simple letter<\/strong> describing in detail the facts of which he or she considers himself or herself to have been the victim.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <strong>public prosecutor<\/strong>, who is the master of the opportunity to prosecute, <strong>will decide<\/strong> whether or not to pursue the complaint by forwarding it to <strong>the competent services<\/strong>.<br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> The complaint will be closed <strong>without follow-up<\/strong> if he considers that the elements presented are <strong>insufficient<\/strong>. <\/span><\/p>\n<h3><\/h3>\n<h3>The role of the lawyer<\/h3>\n<p><span style=\"font-weight: 400;\">The <strong>drafting of the simple <\/strong> complaint requires a particular formalism attached to <strong>the legal syllogism<\/strong> (it is a reasoning aiming at recalling the facts and the appropriate rule of law as well as its application to the case in question).<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> A <strong>properly drafted complaint<\/strong>, which sets out the debate in legal terms and refers to the criminal qualifications of the acts committed, will have a <strong>better chance of attracting the interest of the public prosecutor&#8217;s office<\/strong> and may also serve later as a basis for a <strong>complaint with civil action <\/strong>if necessary.<br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> When an investigation is opened, the <a href=\"\/en\/\"><strong> lawyer<\/strong><\/a> assists his client and regularly exchanges with the police force in order to be <strong>kept informed of the progress of the investigations<\/strong>. <\/span><\/p>\n<p><span style=\"font-weight: 400;\"> If the complaint is<strong> dismissed<\/strong>, the lawyer outlines <strong>the various remedies <\/strong> available to his client in order to obtain compensation for his loss.<\/span><\/p>\n<h3>Benefits<\/h3>\n<p><span style=\"font-weight: 400;\">Filing a complaint allows for <strong>the opening of an investigation<\/strong>. It is particularly useful when the victim has neither <strong>proof<\/strong>, nor the<strong> identity of the perpetrator<\/strong>. The filing of a <strong>complaint against x <\/strong>aims at establishing these elements.<br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <strong>minor victim <\/strong>can file a complaint <strong>alone<\/strong>, without the presence of his legal representatives.<br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> The<strong> simple complaint<\/strong> covers all criminal offences (contraventions, misdemeanours and crimes) committed against property or persons. It allows the public prosecutor to be <strong>informed of the commission of an offence.<\/strong><br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> The <strong>victim cannot be ordered<\/strong> to pay damages or a civil fine (except in the event that the complaint constitutes slanderous denunciation).<br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> There is an <strong>online pre-complaint<\/strong> system for <strong>property offences and for discriminatory acts<\/strong> when the perpetrator is unknown, which <strong>saves time <\/strong>when presenting the complaint to the police station or the gendarmerie. In order to be effective, the <strong>complaint must be signed <\/strong>in these premises.<\/span><\/p>\n<h3><\/h3>\n<h3>Disadvantages<\/h3>\n<p><span style=\"font-weight: 400;\"> The victim can be <strong>prosecuted for slander<\/strong>.<br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <strong>continuation of the investigation <\/strong>remains subject to the decision of the public prosecutor.<br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> In fact, the <strong> simple complaint <\/strong>only leads to effective prosecution in cases where the public prosecutor considers that the <strong>denounced facts are a serious threat to public order.<\/strong>.<br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> Moreover, the complaint <strong>does not interrupt the statute of limitations<\/strong>. . This means that the victim will have and be <strong>vigilant <\/strong>in order to prevent the offence from being time-barred. The statute of limitations is a period of time after which no further action can be taken.<br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The author of the simple complaint can be prosecuted for <strong>slander<\/strong>. The <strong>withdrawal<\/strong> of the complaint will not allow him to avoid being held responsible.<br \/>\n<\/span><\/p>\n<h3><\/h3>\n<h3 style=\"color: blue; text-decoration: underline;\">What about the statute of limitations ?<\/h3>\n<div style=\"text-align: center;\">\n<h3 style=\"text-decoration: underline;\">What is the time limit for filing a complaint?<\/h3>\n<h4>(articles 7 to 9 of the Code of penal procedure)<\/h4>\n<\/div>\n<p><span style=\"font-weight: 400;\"> The victim will have to act quickly if he wants to escape the statute of limitations. The time limit starts to run <strong> from the moment the offence is committed<\/strong>. The victim will have <strong>one year<\/strong> for contraventions, <strong>six years<\/strong> for misdemeanors and <strong>twenty years <\/strong>for crimes to act.<br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><br \/>\nThe<strong> statute of limitations<\/strong> is very short for <a href=\"https:\/\/braun-avocat.com\/en\/defamation-and-communication-law\/\">press offenses <\/a> based on the Law of July 29, 1881. <\/span><\/p>\n<p><span style=\"font-weight: 400;\"><br \/>\nIf the victim <strong>was a minor<\/strong> at the time of the facts, the statute of limitations will begin to run<strong> from the date of his or her majority<\/strong>. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Certain<strong> crimes<\/strong> considered <strong>particularly serious<\/strong> (terrorism, crimes of eugenics and reproductive cloning, enforced disappearances, etc.) are subject to <strong>a thirty-year statute of limitations<\/strong>.<\/span><\/p>\n<h2 id=\"plainte_const\">THE COMPLAINT WITH CONSTITUTION OF CIVIL PARTY<\/h2>\n<h3>Definition<\/h3>\n<p><span style=\"font-weight: 400;\">When the<strong> simple complaint<\/strong> has not <strong>been answered<\/strong> within <strong> three months<\/strong>, or when it has been <strong>closed without any follow-up<\/strong>, the victim can resort to a <strong>complaint with civil party status<\/strong> (complaint filed with the Dean of the investigating judges) if he\/she wishes to <strong>open an investigation <\/strong>(the term &#8220;investigation&#8221; here refers to the inquiry conducted before the investigating judge).<br \/>\n<\/span><\/p>\n<h3>The role of the lawyer<\/h3>\n<p><span style=\"font-weight: 400;\"> The<strong> admissibility of the complaint with civil party status <\/strong> is subject to several <strong>procedural conditions<\/strong>. The use of a <strong>lawyer<\/strong> makes it possible to ensure that these<strong> conditions are respected <\/strong> and to <strong>increase the chances of seeing the complaint succeed.<br \/>\n<\/strong><\/span><\/p>\n<p><span style=\"font-weight: 400;\">When the complaint is <strong> accepted by the investigating judge<\/strong>, the civil party is associated with the procedure. From then on, he or she can make <strong>additional observations<\/strong> or <strong> request actions from the<\/strong> investigating judge. These requests are subject to <strong>strict deadlines<\/strong> and<strong> require precise legal argumentation<\/strong>. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <a href=\"\/en\/\"><strong> lawyer<\/strong><\/a> assists the civil party during the <strong>investigation,<\/strong> particularly during hearings and <strong>confrontations. <\/strong>. The lawyer<strong> can appeal <\/strong>certain orders and <strong>raise nullities<\/strong>.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When the physical injury suffered is significant, <a href=\"https:\/\/braun-avocat.com\/en\/civi\/\">the lawyer will also refer the case to the Crime Victims&#8217; Compensation Commission<\/a>.<\/span><\/p>\n<h3>Advantages<\/h3>\n<p><span style=\"font-weight: 400;\">The<strong> complaint with civil party status <\/strong>makes it possible to <strong>\u00ab\u00a0force\u00a0\u00bb the opening of a criminal investigation <\/strong> by the opening of the information.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <strong>complainant, by becoming a civil party, becomes a party to the proceedings<\/strong>, has access to them and can make <strong>requests for action<\/strong>.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><br \/>\nIn addition, it<strong> interrupts the limitation period<\/strong>.<\/span><\/p>\n<h3>Disadvantages<\/h3>\n<p><span style=\"font-weight: 400;\">The <strong>payment of a deposit is mandatory<\/strong>, except for victims receiving legal aid.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The<strong> investigating judge sets the <\/strong>amount of the deposit according to <strong>the victim&#8217;s income<\/strong>, as well as<strong> the time limit <\/strong> within which it must be paid.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The author of a complaint with civil party constitution judged unfounded <strong>is liable<\/strong>. It is therefore important to <strong>keep the procedure alive <\/strong> by making requests for acts and approaches to the judge.<\/span><\/p>\n<h2 id=\"citation_direct\">THE DIRECT SUMMONS<\/h2>\n<h3>Definition<\/h3>\n<p><span style=\"font-weight: 400;\"> The<strong> direct summons <\/strong>makes it possible to bring the case directly before <strong>the competent court<\/strong>. This approach implies that <strong>the victim knows the author of the facts <\/strong> and has<strong> irrefutable evidence<\/strong>. \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> The direct summons only concerns <strong>misdemeanors<\/strong> and <strong> infractions<\/strong>. Crimes are dealt with by the Assize Court, which can only be seized after <strong>an investigation by an investigating judge<\/strong>.<\/span><\/p>\n<h3>The role of the lawyer<\/h3>\n<p><span style=\"font-weight: 400;\">The<strong> assistance of a lawyer is essential<\/strong> to draft the direct summons in extremely precise terms. Each offence must be precisely <strong>supported<\/strong>, <strong> demonstrated<\/strong>, and <strong>legally qualified<\/strong>.<\/span><\/p>\n<h3>Advantages<\/h3>\n<p><span style=\"font-weight: 400;\"> The direct summons allows the case to<strong> be brought directly before the court.<\/strong>.
